## 1. Acceptance

By creating a SomaSkul account or using the SomaSkul app, you agree to these Terms and to SomaSkul's Privacy Policy (PRIVACY_POLICY.md).

## 2. Eligibility

SomaSkul is intended for secondary school students studying the CBC or KCSE curriculum in Kenya. [LEGAL REVIEW REQUIRED / BUSINESS DECISION REQUIRED: SomaSkul does not currently verify a user's age at signup. The operator must decide and state a minimum age or guardian-involvement requirement, informed by LEGAL_COMPLIANCE_AUDIT.md §1 and §9, before this section can be finalized.]

## 3. Accounts — how SomaSkul accounts actually work today

SomaSkul currently uses a single, self-service account model. There is no separate "parent account" and "student account" in the product today — the person who signs up with a name and phone number is the account holder, and that account is also the one whose phone number is used for payment if a subscription is purchased.

If you are a parent or guardian helping a student use SomaSkul, please read PARENT_GUARDIAN_NOTICE.md, which explains what this means in practice and what SomaSkul is and is not currently able to do to support parental oversight.

## 4. Account security

Because SomaSkul logs you in by phone number without a password, anyone with access to your phone number can access your SomaSkul account. Keep your phone secure. Notify us promptly (§14) if you believe your account has been accessed without authorization.

## 5. Acceptable use

You agree not to:

  • Use SomaSkul to cheat on a proctored or invigilated examination in a way that violates

your school's or examination board's rules. ZANA is deliberately designed to guide you toward understanding rather than hand you final answers — see AI_EDUCATIONAL_DISCLAIMER.md.

  • Attempt to access another user's account or data.
  • Attempt to circumvent SomaSkul's payment or entitlement systems.
  • Upload content that is unlawful, infringing, or that you do not have the right to

share.

  • Interfere with or attempt to disrupt SomaSkul's systems.

## 6. Subscriptions and payment

See SUBSCRIPTION_BILLING_TERMS.md for full pricing, activation, and billing terms, and REFUND_CANCELLATION_POLICY.md for cancellation and refunds. In summary:

  • SomaSkul offers free features and paid subscription plans, activated via M-Pesa

payment.

  • A subscription is only ever activated once Safaricom confirms payment — never by

anything the app itself claims. This protects you: no one can falsely claim to have paid and get access they haven't paid for.

  • When a plan expires, your access is reduced (features become gated) — **your study

history and past results are not deleted** because a subscription lapsed.

## 7. Intellectual property

SomaSkul's app, curriculum content compiled and presented by SomaSkul, and the ZANA tutor persona are SomaSkul's intellectual property, except for:

  • Underlying curriculum standards (CBC/KCSE syllabi), which belong to Kenya's

curriculum authorities and are referenced, not owned, by SomaSkul.

  • Content you submit (your questions, uploaded images) remains yours; you grant SomaSkul

a license to process it in order to provide the service to you (e.g., sending it to our AI provider to generate a response).

## 8. AI-generated content

SomaSkul's tutoring, homework-solving, and revision features use AI (Google's Gemini) to generate responses. AI-generated answers may contain errors. See AI_EDUCATIONAL_DISCLAIMER.md for the full disclaimer, which is incorporated into these Terms by reference.

## 9. Service availability

SomaSkul is designed to work with intermittent connectivity — your local study data stays available while offline, and syncs when you reconnect. We do not guarantee uninterrupted availability of AI features, payment processing, or cloud sync, all of which depend on third-party services (Google, Safaricom, Supabase) outside SomaSkul's direct control.

## 10. Limitation of liability

[LEGAL REVIEW REQUIRED: standard limitation-of-liability language should be drafted by counsel, calibrated to Kenyan consumer-protection law and the fact that SomaSkul's target users may include minors. Not drafted here to avoid inventing legal boilerplate without review.]

## 11. Suspension and termination

SomaSkul may suspend or terminate an account that violates §5 (Acceptable use). SomaSkul does not currently have a self-service account-deletion feature — see DATA_DELETION_POLICY.md for what exists today and what is planned. If SomaSkul terminates your account for a violation, [BUSINESS DECISION REQUIRED: define what happens to a terminated account's data — same retention rules as a voluntary deletion request, or different? Not yet decided.]

## 12. Changes to these Terms

We will update the "Last updated" date above when these Terms change. [BUSINESS DECISION REQUIRED: define the actual notice mechanism — none exists in the app today.]

## 13. Governing law

[LEGAL REVIEW REQUIRED: insert governing law and dispute-resolution clause, appropriate to the operating entity's jurisdiction — not something this audit can determine from code.]
